TERMS OF SERVICE FOR DIGITAL PRODUCTS

Effective date: September 17, 2026

  1. SELLER AND AGREEMENT

GUANIVA is the commercial brand used for this pilot by Rudy Rosales R., located in San Miguel, Santo Domingo, Heredia, Costa Rica.

By placing an order, the customer agrees to these Terms of Service, the Digital Product Refund Policy, the Personal Use License, the Privacy Policy, and any product-specific conditions presented before purchase.

  1. ELIGIBILITY AND ORDERS

Customers must have the legal capacity to enter into a contract or purchase with the authorization of a parent or legal guardian.

GUANIVA may reject or cancel an order before delivery when reasonably necessary to address suspected fraud, pricing errors, legal restrictions, payment problems, or technical issues. Any payment collected for a cancelled and undelivered order will be returned.

  1. PRODUCT INFORMATION

Product descriptions identify the included files, format, language, compatibility, and intended use.

Minor visual differences caused by screen settings, printers, software, or devices do not constitute a defect.

Customers should review the stated technical requirements before purchasing. Unless otherwise indicated, downloadable products are supplied as PDF or ZIP files and require compatible software and sufficient storage space.

  1. PRICES, TAXES, AND PAYMENT

Prices are displayed in the currency shown at checkout. Applicable taxes may be calculated, included, or collected according to the customer’s location and applicable law.

The customer authorizes the selected payment provider to process the transaction. GUANIVA does not receive or store complete payment card details.

  1. DIGITAL DELIVERY

All products covered by these Terms are delivered electronically. No physical product will be shipped unless a product description expressly states otherwise.

Access is normally provided immediately after successful payment through the order confirmation page and the customer’s email address.

Customers are responsible for providing an accurate email address and maintaining access to it.

  1. PRODUCT UPDATES

GUANIVA may issue corrected, improved, or updated versions of a digital product and may notify previous purchasers when an updated file becomes available.

Unless expressly stated in the product description, purchasing a product does not create a promise of indefinite updates, future editions, ongoing support, or additional content.

  1. PERSONAL USE LICENSE

Use of GUANIVA and RESETLY digital products is governed by the Personal Use License.

The original purchaser receives a limited, non-exclusive, non-transferable, revocable license for personal and non-commercial use.

Customers must not share download links or files, resell or redistribute the materials, publish them online, provide copies to clients or groups, create derivative commercial products, or remove copyright, authorship, trademark, or license notices.

Ownership and intellectual property rights are not transferred to the purchaser.

  1. DOWNLOAD SECURITY

Secure download links are intended solely for the purchaser.

The customer must take reasonable measures to protect those links. GUANIVA may disable or replace a link when misuse, unauthorized distribution, or a security risk is reasonably suspected.

This provision does not affect remedies or access rights required by applicable law for legitimate purchasers.

  1. EDUCATIONAL AND WELLNESS CONTENT

RESETLY materials provide general educational and organizational information about meal planning, recipes, shopping, habits, and wellness.

The materials do not constitute medical advice, diagnosis, treatment, psychotherapy, or individualized nutrition counseling, and they are not a substitute for professional care.

No outcome, weight change, health improvement, financial result, or other specific result is guaranteed.

Customers should consult a qualified physician, registered dietitian, or other licensed professional before making material changes to their diet, exercise, medication, or health routines, particularly when they have a medical condition, allergies, take medication, are pregnant or breastfeeding, are under 18, or require a therapeutic diet.

  1. ALLERGIES AND FOOD SAFETY

Customers are responsible for reviewing ingredients, product labels, allergens, cross-contact risks, food handling, storage, cooking temperatures, and suitability for their individual circumstances.

Ingredient brands and formulations may change. GUANIVA does not control third-party ingredients, manufacturing environments, or food preparation conditions.

  1. THIRD-PARTY SERVICES

The store may rely on Shopify, payment processors, email providers, digital-delivery services, and other third-party providers.

Their availability and separate terms may affect payment processing, communication, and delivery. GUANIVA remains responsible for obligations that applicable law does not permit it to exclude.

  1. REFUNDS AND TECHNICAL PROBLEMS

Refunds, duplicate purchases, inaccessible or defective files, unauthorized transactions, and technical problems are governed by the Digital Product Refund Policy.

Customers should contact hello@guaniva.com and provide their order number and a description of the issue.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, GUANIVA is not liable for indirect, incidental, special, or consequential losses resulting from use of, or inability to use, the digital content.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or mandatory consumer protections.

Where legally permitted, any monetary limitation will not exceed the amount paid for the affected product.

  1. GOVERNING LAW AND CONSUMER RIGHTS

These Terms are governed by the laws of Costa Rica, without depriving consumers of mandatory protections applicable in their country of residence.

The parties should first attempt to resolve disputes in good faith by contacting hello@guaniva.com.

Any competent consumer authority or court retains the jurisdiction granted by applicable law.

  1. CHANGES AND SEVERABILITY

GUANIVA may update these Terms for future transactions. The version presented when a purchase is made governs that order unless a later change is required by law or benefits the customer.

If any provision is found to be unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

  1. INTELLECTUAL PROPERTY AND BRAND STATUS

All content, product names, designs, photographs, illustrations, recipes, worksheets, files, and branding remain the intellectual property of the seller or identified rights holder.

GUANIVA and RESETLY are currently used as commercial brand identifiers for this pilot. Their use does not represent that trademark registration has been completed.
